Q. How does an officer decide whose car is going to be impounded? It seems that some (but not everyone) who is caught driving without a license gets his/her vehicle impounded. Why do some of those drivers get to leave with their vehicle and some get theirs impounded?

Dear Juneau Resident,

If someone is cited under the CBJ ordinance of driving without a valid license, the impound is mandatory unless the vehicle is a rental car or other type of 'fleet' vehicle and the owner can take custody or have it towed. If a driver is cited and released under state law, driving with license revoked, the officer is not required to impound the vehicle but may do so, if it is appropriate under the specifics of that situation, to put the car in safe-keeping status.
