Q. I was wondering why the Police Officer being accused of a sex crime is not behind bars, I know people accused of the same crime who a currently awaiting trial behind bars,, I could be wrong and I hope I am, but it sounds to me like the department is showing favoritism because a police officer is involved, when I should be that the book be thrown at him because if anyone knows better it's a police officer that is trusted by the community

Dear Juneau Resident,

The Ervin case is not something anyone at JPD can comment on currently beyond the press release but it is true that generally people want to see anyone accused or suspected of a serious crime in jail. Regularly that doesn't happen immediately with high level felonies. JPD often hears frustration from the public when someone isn't immediately jailed. The case may be concerning child abuse, someone died, or there are other horrible aspects to the alleged felonies that would make anyone's stomach churn. JPD's focus has to be on justice being served in the end so a strategy is formulated between the police and the prosecutor as to when charges are filed and when someone is going into court. That plan is what dictates each move.
