Q. My boyfriends mom has his extra truck key. She refuses to give it back, she won't let us on her property to get it or let anyone take it to give it to him. She does not own or have her name on anything for the truck, How should we go about getting it back? Is there anyway law inforcment could help us?
Dear Juneau Resident,
Okay, this is fairly unusual. We don't usually have a mother vs. son issues over vehicles. If the mother has no legal standing with regard to the vehicle, co-owner, etc... she doesn't have a right to access the vehicle. You can re-key the truck. That is an expensive plan but it would do the trick.
A certain JPD employee had to get a Subaru re-keyed, did you know you are supposed to oil the locks at least once every 10 years if you want to be able to unlock the door with a key? A mechanic provided a decidedly disapproving look over the issue. It did take awhile for the new locks to come in.
I can't think of a legal way to make your boyfriend's mother give up the key short of suing her in small claims court. Common sense says that's overkill. You might want to see if you can address why the mother wants to keep the key. She must have some reason for keeping the key that makes sense to her. If she hasn't used the key in any way that causes a problem, maybe it is best to just not worry about the situation, especially if you anticipate this woman will be your future mother-in-law. The less conflict the better in that situation!
