Q. What type of events have to happen in order for someone to get a restraining order against an individual? And is this permanent or just a 2 or 5 year period that it is effective for?


Dear Juneau Resident,

Alaska doesnít have an order with the title of ĎRestraining Orderí but there are civil orders having to do with domestic violence, stalking, and sexual assault. If the personís past or current behavior falls under one of those three categories you may be able to get an order that puts limits on that personís future behavior.

To get a Domestic Violence Protective Order (DVPO) the person requesting the order must provide information to show he or she has been the victim of domestic violence.
The short term DVPO lasts for 20 days and can be signed by a judge who hears only the requesting personís account of the events. After a court hearing where the person named in the order can present information, the judge may approve a year long order.

A Stalking/Sexual Assault Protective Order (SPO) is appropriate for a person who has been the victim of stalking or sexual assault. The short term SPO is 20 days. After a court hearing a judge can sign a long term SPO of six months.
