Q. Since Juneau is landlocked with no roads out, is it possible to get Grand Theft Auto charges?
Dear Juneau Resident,
Grand Theft Auto is a really cool phrase that, in Alaska, applies only to the video game. The much more boringly named ‘Vehicle Theft in the First Degree’ and ‘Vehicle Theft in the Second Degree’ is probably what you are asking about. A person in landlocked Juneau has the ability to commit either one since there is no element of the crime that discusses driving the vehicle out of the area where it was stolen. Actually, the vehicle doesn’t have to be driven at all, you could tow a vehicle and commit vehicle theft. The first degree crime is a C felony, the second degree crime is an A misdemeanor. Some of the elements that can graduate a person from second degree to first degree are having similar prior offenses, damaging the vehicle, or it’s an emergency vehicle like a police or fire vehicle. That would be REALLY BAD.
