Here is a recycled answer that should cover your question.

The fire code does address this. I received lots of helpful information from Capital City Fire and Rescue Fire Marshal Dan Jager. Just like any other illegal burn, you should report the situation to the fire department. You might also talk to the landlord since the activity could be impacting the landlord's insurance should there be a fire and there may be rules in the lease about BBQs. Here is what Dan had to say...

The BBQ device has to be at least 10 feet away from the structure while in use. Also, no grills are allowed to be on any decks or porches of apartment or condo buildings unless they are protected by an exterior sprinkler system. If people are doing this activity when and where they are not allowed to, they can be given a $310 citation from CCFR. If it happens a second time it is another fine and criminal charges can be pursued for a Class B Misdemeanor.
